You are responsible for any such charges incurred by your mobile carrier.
Carriers are not liable for delayed or undelivered messages.

We value your privacy and comply with all applicable data protection laws.

We do not sell or share your mobile number, opt-in records, or consent data with third parties, except as necessary to deliver SMS messages through our VOIP or SMS service providers, comply with carrier requirements, or respond to valid legal requests.

All opt-in and consent information is securely stored and used only for compliance and operational purposes.

6. Disclaimer of Liability

SMS messages are provided on an “as is” and “as available” basis.

We do not guarantee successful delivery or timeliness of messages, as this depends on your carrier and technical factors outside our control.

By participating, you agree that Jay Street Group, LLC, its owners, employees, affiliates, and service providers are not liable for any direct, indirect, incidental, or consequential damages resulting from your participation in or reliance on our SMS program.

This includes, without limitation, any damages or claims related to:

-Failed, delayed, or misdirected messages

-Errors in transmission

-Technical failures of any kind

-Loss of data or access

-Errors or omissions in the content of the messages

9. Governing Law & Dispute Resolution

These SMS Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.

Any disputes arising out of or relating to these SMS Terms will be resolved through binding arbitration in Dallas County, Texas, under the rules of the American Arbitration Association (AAA).

You agree to waive any right to participate in a class action, collective action, or representative proceeding. All claims must be brought individually.
